Participation Waiver & Release for Adaptive Swim Readiness Course

1. Program Description

The Online Program Adaptive Swim Readiness: Helping Parents Build Comfort, Confidence, and Safety Around Water Participation Waiver and Release (“Program”) is an instructional resource designed for parents or legal guardians (“Parent/Guardian”) to help introduce their children to water, develop basic comfort in aquatic settings, and learn fundamental water appreciation concepts. This Program is for educational purposes only and is not a substitute for formal swim lessons or in-person professional instruction.

2. Acknowledgment of Child’s Starting Ability

By participating, the Parent/Guardian acknowledges and agrees that the child:

  • May be a non-swimmer or beginner-level participant.
  • Will only engage in activities that the Parent/Guardian determines to be safe and appropriate for the child’s age, ability, and comfort level.
  • Must be under direct and constant supervision of the Parent/Guardian or another responsible adult any time the child is near or in water.

3. No Unsupervised Water Activities

The Program does not require or encourage any unsupervised water exposure and all activities must be:

  • Performed only with adult supervision,
  • Conducted in safe, controlled environments (e.g., shallow water, bathtubs, splash pads, or other parent-approved settings),
  • Adjusted or discontinued immediately if the child displays discomfort, fear, or any unsafe behavior.

4. Parent/Guardian Responsibilities

The Parent/Guardian affirms that:

  • They are solely responsible for their child’s safety during all Program activities.
  • They understand water activities carry inherent risks, including but not limited to slips, falls, water inhalation, and drowning.
  • They will continuously monitor and evaluate the child’s safety, abilities, and well-being.

Bright Star Swim Academy is not supervising or observing any activity performed at home or in any other location.

5. Assumption of Risk

The Parent/Guardian understands and voluntarily assumes all risks associated with:

  • Introducing the child to water,
  • Encouraging water comfort,
  • Activities inspired by or demonstrated within the Program.

Bright Star Swim Academy is not liable for any injuries, accidents, loss of life, or damages that may occur during or after participation.

6. Release of Liability

In consideration of accessing the Program, the Parent/Guardian agrees on behalf of themselves, the child, and their family, heirs, and representatives to waive, release, and hold harmless:

  • Bright Star Swim Academy,
  • Its owners, instructors, staff, contractors, and affiliates,

from any and all liability, claims, demands, loss of life, or causes of action arising out of participation in the Program, including those related to injuries, accidents, or property damage.

7. No Professional or Emergency Advice

The Program provides general educational information only. It does not constitute professional instruction, individualized advice, or emergency guidance. Parents/Guardians must seek appropriate professional assistance for:

  • Swim instruction beyond water comfort,
  • Safety concerns,
  • Any emergency situation.

8. Consent for Participation

By accessing or using the Program materials, the Parent/Guardian acknowledges they have:

  • Read, understood, and agreed to this Waiver and Release;
  • The authority to consent for the minor child;
  • Accepted full responsibility for the child’s safety and participation.
