PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE BRIGHT STAR SWIM ACADEMY WEBSITE, DIGITAL PRODUCTS, PRINTED PRODUCTS, OR ONLINE COURSES. BY ACCESSING OR USING ANY OF OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (the “User,” “parent,” or “guardian”) and Bright Star Swim Academy, LLC, a Florida limited liability company (“Company,” “we,” “our,” or “us”), governing your access to and use of our website and online learning platform accessible at brightstarswim.com (the “Platform”), as well as our digital and printed products, online courses, and mobile, in-person swim instruction booked through the website (collectively, the “Services”).
If you do not agree to these Terms, you must immediately discontinue use of our Services.
1. ACCEPTANCE OF TERMS
By accessing our website or Platform, purchasing any product or service, downloading digital materials, or enrolling in an online course, you represent that: (a) you are at least 18 years of age or are the legal parent or guardian of any minor; (b) you have the legal authority to enter into this agreement; and (c) you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
2. USE OF WEBSITE AND SERVICES

3. ACCOUNTS AND ACCESS
To access certain features of our Services, you may be required to create an account or redeem an Access Code. You agree to provide accurate, complete, and current registration information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not share your login credentials or Access Code with any other person.
If you become aware of any unauthorized access to or use of your account, you must notify us immediately at Info@BrightStarSwimAcademy.com. We reserve the right to suspend or terminate accounts for misuse, violation of these Terms, or any conduct we determine to be harmful to our Services or other users. Redemption of an Access Code constitutes your acceptance of these Terms and governs your right to access any content made available through the Services.
4. DIGITAL PRODUCTS
Bright Star Swim Academy offers downloadable digital products including the individual program booklets and instructional materials from the Adaptive Swim Readiness Program, as well as other PDF guides, curricula, and workbooks (collectively, “Downloadable Materials”), all of which are made available through the Platform.
5. PLATFORM AND DOWNLOADABLE CONTENT ACCESS
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to: (a) access and use the Platform via a supported web browser or other interface made available by the Company; (b) view and interact with course content and instructional materials on the Platform solely for your personal, non-commercial use; and (c) download Downloadable Materials strictly in accordance with these Terms and the copyright notices embedded within those materials. This license does not grant you any ownership interest in the Platform or any content. All rights not expressly granted are reserved by the Company.
Where the Platform makes Downloadable Materials available, you are granted a strictly limited, personal, non-commercial, non-transferable license to download a single copy to your personal device and view it for your own personal use in connection with our educational programs. This download license grants no other rights.
Each Downloadable Material contains an embedded copyright notice, the terms of which are incorporated into this Agreement by reference and are binding on all users. By downloading any Downloadable Material, you acknowledge that you have read, understood, and agree to be bound by the copyright notice contained within that material.
6. ONLINE COURSES AND PROGRAMS

7. ADAPTIVE SWIM READINESS PROGRAM
The following terms apply specifically to the Adaptive Swim Readiness Program, available as an online course or as individual downloadable booklets and printed booklets. This program is an educational resource for parents, legal guardians, and caregivers. It is not a substitute for formal swim lessons or in-person professional instruction by a certified swim professional, and Bright Star Swim Academy is not present, supervising, or observing any activity the parent or guardian undertakes at home or at any other location. By enrolling in or purchasing the Adaptive Swim Readiness Program, the parent or guardian acknowledges and agrees that:
Bright Star Swim Academy has no visibility into, and bears no responsibility for, activities performed at home or any other location outside of our direct supervision under an in-person, personalized swim instruction course booked directly through Bright Star. In addition to the general assumption of risk and release provisions set forth in these Terms, the parent or guardian voluntarily assumes all risks associated with introducing the child to water, encouraging water comfort, and performing any activities inspired by or demonstrated within the Program, including but not limited to slips, falls, water inhalation, near-drowning, and drowning. The parent or guardian agrees to release and hold harmless the Released Parties from any and all claims arising out of or related to participation in the program or any activity undertaken in connection with it.
8. IN-PERSON SWIM INSTRUCTION
Bright Star Swim Academy offers mobile, in-person, personalized swim instruction for children, teens, and adults in the Ocala, Florida area and surrounding regions. In-person swim instruction is booked and paid for directly through the website and is subject to the following conditions:
These Terms govern the commercial and transactional aspects of in-person swim instruction booked through the website, including booking, payment, and scheduling. The liability release provisions applicable to physical participation are governed by the executed waiver.
9. PAYMENTS AND BILLING
All payments are processed securely through PayPal via WooCommerce. By completing a purchase, you agree to provide accurate, current, and complete billing and payment information, to authorize PayPal to process your payment to your designated payment method, and to accept PayPal’s terms of service and privacy policy in connection with your payment. Access to online course content may be granted through individual purchase or through an access key code (“Access Code”) obtained from an authorized partner or affiliate. Each Access Code is valid for one (1) year from the date of activation and may be used only by the intended recipient. Access Codes are non-transferable and may not be resold, gifted, or shared except as expressly authorized in writing by Bright Star Swim Academy in each instance. We do not store full payment card details on our servers. All payment processing is governed by PayPal’s terms. We reserve the right to modify pricing at any time, with updates posted on our website prior to becoming effective.
10. SALES TAX
Florida sales tax and applicable county surtax are applied to taxable products based on the buyer’s delivery ZIP code, in accordance with applicable laws. You are responsible for any applicable sales, use, or other taxes imposed by your jurisdiction.
11. INTELLECTUAL PROPERTY
All content available through our Services and on the Platform, including but not limited to text, graphics, logos, images, photographs, videos, audio recordings, Downloadable Materials, course materials, curricula, workbooks, instructional content, and software, is the exclusive property of Bright Star Swim Academy, LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and our content solely for your personal, non-commercial use in connection with our Services. You may not, without our prior written permission:
Any unauthorized use of our intellectual property may result in immediate termination of access to our Services and may subject you to legal liability.
12. NOTICE
The online courses, digital and printed materials, videos, booklets, and workbooks made available through Bright Star Swim Academy are educational resources designed for parents, legal guardians, and caregivers. They are intended as an aid to help introduce children to the water, develop foundational safety awareness and water comfort, and support positive, developmentally appropriate experiences in aquatic settings.
These materials are not all-inclusive and do not cover every situation, environment, or individual need that may arise in or around water. They provide general educational information only and are not a substitute for professional safety inspections, formal swim lessons, or in-person instruction by a certified swim professional. Completion of any course or program does not certify a child as a competent or safe swimmer at any level.
These materials do not constitute professional instruction, individualized coaching, therapeutic services, emergency guidance, or medical advice. They are not designed or intended to be used as a stand-alone water safety solution.
Bright Star Swim Academy does not evaluate, diagnose, assess, or provide recommendations regarding any child’s medical, developmental, behavioral, neurological, sensory, or physical condition. All materials offered are intended to provide general educational information only and is not a substitute for medical advice, occupational therapy, physical therapy, behavioral therapy, speech therapy, applied behavior analysis (ABA), or other professional services. Parents and caregivers are solely responsible for determining whether any activity is appropriate for their child and should consult qualified professionals as necessary.
The effectiveness of these materials depends significantly on the consistency, attentiveness, and judgment of the supervising adult. Individual outcomes will vary based on the child’s age, developmental stage, prior water experience, physical abilities, and the environment in which activities are conducted.
Direct and constant adult supervision is the single most important layer of protection any time a child is in or near water, regardless of the child’s skill level, comfort with water, or participation in any Bright Star Swim Academy program. No course, program, or educational material is a substitute for that supervision. Completion of any program offered by Bright Star does not make a child “water safe,” “drown-proof,” or otherwise eliminate the risk of injury or drowning.
13. ASSUMPTION OF RISK
Water-based activities, including participation in mobile, in-person swim instruction booked through the website, as well as activities demonstrated or inspired by our digital or printed materials, videos, online courses, workbooks, or instructional content, involve inherent risks, including the risk of physical injury or drowning. These risks exist regardless of the precautions taken. By using our Services, you, as the parent, guardian, or participant, voluntarily and knowingly assume all risks associated with:
YOU UNDERSTAND AND AGREE THAT ALL ACTIVITIES DESCRIBED OR DEMONSTRATED IN OUR SERVICES MUST BE PERFORMED UNDER DIRECT AND CONSTANT ADULT SUPERVISION AT ALL TIMES.
For your child’s safety and well-being, please consult with your child’s physician before beginning any new physical activity or water-based routine.
14. RELEASE OF LIABILITY AND INDEMNIFICATION
In consideration of accessing and using our Services, you, on behalf of yourself, your child, and your respective heirs, executors, administrators, and legal representatives, agree to:
RELEASE AND HOLD HARMLESS: BRIGHT STAR SWIM ACADEMY, LLC, ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, INSTRUCTORS, INDEPENDENT CONTRACTORS, AGENTS, AND AFFILIATES (COLLECTIVELY, THE “RELEASED PARTIES”) FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, EXPENSES, OR LIABILITY OF ANY KIND, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, ILLNESS, ACCIDENT, LOSS OF LIFE, OR DEATH, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
INDEMNIFY AND DEFEND: YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM AND AGAINST ANY CLAIMS, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES) ARISING OUT OF OR RELATED TO: (A) YOUR BREACH OF THESE TERMS; (B) YOUR USE OR MISUSE OF OUR SERVICES; (C) YOUR VIOLATION OF ANY APPLICABLE LAW OR REGULATION; OR (D) ANY CLAIM BY OR ON BEHALF OF YOUR CHILD ARISING FROM PARTICIPATION IN ACTIVITIES RELATED TO OUR SERVICES.
15. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BRIGHT STAR SWIM ACADEMY, LLC OR ANY OF THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE OUR SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRECEDING THE DATE OF THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
16. DISCLAIMER OF WARRANTIES
OUR SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We make no representations or guarantees regarding specific outcomes from use of Downloadable Materials, online courses, or other programs available through the Platform. Individual results may vary based on many factors, including supervision quality, physical environment, and the individual needs of the participant.
17. THIRD PARTY PLATFORMS AND SERVICES
Certain features of our Services, including the delivery of online courses and digital content, may be provided through or hosted by third-party platforms and service providers. While we take reasonable care in selecting our partners, we do not control and are not responsible for the availability, performance, security, or content of any third-party platform. Your use of any third-party platform may be subject to that platform’s own terms of service and privacy policy, which are separate from and independent of these Terms. We are not liable for any interruption, error, data loss, or other harm arising from the acts or omissions of any third-party platform or service provider. In the event that a third-party platform becomes unavailable or discontinues service, we will make reasonable efforts to provide alternative access to course content, but we make no guarantee of continuity of access through any particular platform.
18. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or our Services that cannot be resolved by good-faith negotiation shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
Any arbitration shall be conducted in Marion County, Florida. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
19. PRIVACY

20. TERMINATION
These Terms are effective until terminated. We may terminate or suspend your access to our Services and the Platform immediately and without prior notice for any violation of these Terms or conduct we determine, in our sole discretion, to be harmful to the Company, other users, or third parties. Upon termination: (a) your right to access and use the Services and the Platform immediately ends; (b) you must cease all use of the Platform; and (c) you must delete or destroy any Downloadable Materials in your possession. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Intellectual Property, Notice, Assumption of Risk, Release of Liability and Indemnification, Limitation of Liability, Disclaimer of Warranties, and Governing Law and Dispute Resolution.
21. FORCE MAJEURE
Bright Star Swim Academy will not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, fire, flood, war, terrorism, civil unrest, governmental action or regulation, internet or telecommunications outages, third-party platform failures, power failures, or labor disputes. In such events, our obligations will be suspended for the duration of the force majeure condition, and we will make reasonable efforts to resume performance as soon as practicable.
22. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the Effective Date at the top of this document and, where appropriate, by posting a notice on our website. Your continued use of our Services after any modification constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
23. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible.
24. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund Policy, and any other policies or agreements expressly incorporated herein, constitute the entire agreement between you and Bright Star Swim Academy, LLC with respect to the subject matter hereof and supersede all prior or contemporaneous agreements, understandings, and representations.
